Creative Printables is a platform that enables users to publish their designs on a variety of merchandise. Users can sell pre-designed products, generate designs, incorporate them into products, and offer their designed products for sale. Creative Printables facilitates the printing, shipping, or dropshipping of physical products to the “End Customer.”

 

Eligibility

Our services are exclusively accessible to individuals who can legally form binding contracts under applicable law.

 

Our Service

 

GBTG, through the Creative Printables service, delivers a range of services for publishing, selling, promoting, and purchasing content and items. Users can interact with other users and benefit from GBTG’s product fulfillment, which includes payment processing and customer services. Additionally, GBTG manages the fulfillment of products to end customers.

 

The digital content on the website (“your content”) can encompass information, text, data, graphics, images, photographs, sound, video, music, or any other material posted online.

 

Should an order be placed, GBTG will use your instructions to manufacture and ship the physical product (“the product”), adhering to the specified form provided by you or the customer.

 

Offers
 

The basic subscription for Creative Printables is free. However, additional or upgraded services may be offered for a fee. Subscribers to fee-based services are required to supply their credit card information. Fees for the selected service plan or usage will be billed to the credit card provided at registration or to a default service plan for subscribers chosen by GBTG. All services, including upgraded or other fee-based services, are subject to these Terms or specific agreements for those additional services.

 

Account

 

To access and use the Service, you are required to establish a User Account. The registration process requires users to provide current, complete, and accurate information as prompted by the registration form. Users must agree to submit accurate, current, and complete information and promptly update it as necessary.

 

GBTG retains the right to suspend or terminate a User Account if suspicion arises regarding the accuracy, currency, or completeness of user information. Each User must select a personal, non-transferable password.

 

User Accounts, and Hosted Stores, cannot be sold, transferred or assigned to any other individual or User, under any circumstances.

 

Users are solely responsible for activities under their User Account, including ensuring proper logout at the end of each session and possessing necessary rights to the content submitted. Any unauthorised use of the Site, Services, and data may incur a fee, and users are liable for legal fees incurred by GBTG. Unauthorised use encompasses any violations of these Terms.

 

Content

 

Users can submit Content to the Service, including user comments. GBTG does not guarantee confidentiality for any submitted Content. Users are solely responsible for their Content and the consequences of publishing that Content.  Users affirm that they own or possess the necessary licenses, rights, consents, and permissions to publish submitted Content. Users grant GBTG a worldwide, non-exclusive, sub-licensable license to utilise, display, distribute, publish, transmit, modify, and edit their Content for the operation and provision of Services. This license persists while the Content is on GBTG’s online platform, automatically terminating upon removal. GBTG may request additional consent for using Content in publicity or promotion.

 

The granted license extends to passing these rights to other service providers with contractual relationships related to the Services, solely for providing such Services.

 

Users declare that submitted Content will not contain third-party copyrighted material or infringe on proprietary rights. GBTG disclaims liability for any Content and reserves the right to remove Content without notice.

 

Prohibited Content on the platform includes copyrighted material, child exploitation, harassment, bullying, defamation, threats, hate content, illegal activities, personal and confidential information, self-harm, and affiliations with or support for terrorist organisations.

 

End User Purchases
 

Users must refrain from making or accepting payments outside the Creative Printables Website. A fee, including an introduction fee, applies if transactions occur off-platform.

 

GBTG retains the right to add, edit, or remove products without notice to accommodate supply restrictions. In case a product is unavailable, efforts will be made to replace it with the most similar product available. If replacement is not feasible, the order will be cancelled, and the customer notified and refunded.

 

Commission Payments for Creative Printables Hosted Stores

GBTG agrees to pay a commission to Store Owners for eligible product sales. The commission is determined at the outset of the Contract and recorded in the User Account. Refunds and returns are excluded from the Commission calculation.

Currency: All Commission payments shall be denominated in the agreed-upon currency (GBP). In the event of any discrepancy or dispute concerning the accuracy of the Commission calculation, the parties shall engage in good faith efforts to promptly resolve the matter.

Payout Frequency: Commission payouts shall normally be made on a monthly basis.

Eligibility Criteria: Store Owners must adhere to the terms and conditions set forth by GBTG to be eligible for commission payouts.

GBTG reserves the right to withhold commission payments for any sales that are deemed fraudulent, in violation of the Terms of Service, or involve disputed transactions.

Payment Method: Commission payouts shall be made via PayPal transfer to the PayPal account submitted by the Store Owner through the CP Website. Payout accounts cannot be amended except by logging into the User Account and making the changes there.

GBTG is not responsible for any fees associated with the chosen payment method.


Adjustments and Disputes: In the event of any disputes or discrepancies in commission calculations, the parties shall work together in good faith to resolve the matter.

GBTG reserves the right to make adjustments to commission payouts if errors or inaccuracies are identified.

Termination and Forfeiture: In the event of termination of this agreement, for any reason, the Store Owner shall only be entitled to receive commission payments for eligible sales made before the termination date.

Any commission payments owed to the Store Owner but remaining unpaid at the time of termination shall be forfeited.

GBTG reserves the right to modify the commission structure and payout terms with prior written notice to the Store Owner.

Taxes

Users are responsible for paying applicable taxes, including sales taxes, VAT, GST, and others, associated with the Products.

 

Outbound Communication from Creative Printables

 

GBTG may contact the End Customer directly for the purpose of fulfilling or managing an order placed through the Creative Printables Website.

 

User Conduct and Restrictions

 

Users are prohibited from modifying, distributing, or attempting to disassemble any code used in connection with the Services. Marketing, selling, or reselling the Service to third parties is also prohibited. Users agree not to use the Service for unauthorised advertising, collecting information without consent, transmitting objectionable material, infringing intellectual property rights, interfering with the Service, or using it for commercial purposes without GBTG's approval.

 

Non-compliance may result in fees and other remedies available to GBTG, including seeking injunctive relief.

 

GBTG has no obligation to monitor the Service but reserves the right to access, delete, and disclose information as necessary to comply with legal requirements.

 

Termination
 

GBTG may terminate user access or suspend access to the Service without notice for any reason. Users may terminate their account at any time by ceasing use of the Service and requesting account closure.

 

Upon termination, rights and licenses granted to users shall cease immediately.

 

Indemnification

 

Users agree to indemnify and hold GBTG and its affiliates harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of user violation of these Terms or user infringement of any intellectual property or other right of any person or entity.

 

Disclaimer of Warranties and Limitation of Liability

 

The Service is provided on an "as-is" and "as-available" basis. GBTG does not warrant that the Service will be uninterrupted, secure, or error-free.

 

GBTG is not liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses.

 

GBTG disclaims any liability for any content posted on the Service, including the availability or accuracy of such content.

 

GBTG does not warrant that the quality of any products, services, information, or other material purchased or obtained by users will meet their expectations, or that any errors in the Service will be corrected.

 

GBTG is not responsible for the actions, content, information, or data of third parties, and users release GBTG from any claims and damages arising out of such third-party activities.

The Service, including all content, trademarks, logos, trade names, and service marks, is the property of GBTG or its licensors and is protected by copyright, trademark, and other laws.

These Terms constitute the entire agreement between users and GBTG and govern User use of the Service.

If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect.

 

The parties acknowledge that the English language version of these Terms will prevail over any translations.

 

Changes to Terms of Service

 

GBTG reserves the right to modify or replace any part of these Terms at any time. Notice of any material changes will be provided at least 30 days prior to the effective date of the changes. What constitutes a material change will be determined at GBTG's sole discretion.
